Step 3: Create your video in one of the following standard formats: mp4, m4v, mov, m2v, 3gp, avi, mpeg. Maximum allowed file size is 64MB.
Step 4: Click the Upload Video button, complete the Entry Form, and choose the video file you created
Step 5: Share with your friends and try to get the most votes!

A winner will be chosen from the Top 10 videos with the most votes and will be judged based on the following criteria: creativity, extent to which the video captured the spirit of the original Office Party Dance, and entertainment value.

  • All participants who vote, share, or upload a video will receive a confirmation email from sSnapp!
  • Contestants must use the sSnapp! sharing system when entering the contest in order for their referrals to count.
  • No purchase is necessary to play or win.
  • The contest will end on December 24, 2013 at 11:59 CST
  • We encourage you to share the deal as often as you want in order to increase your chances of winning. Each person will be limited to sharing each medium once per day.
  • Winners will be announced by OfficeMax.

OVERVIEW:

The OfficeMax Elf Yourself: “Groove Your Inner Elf” for Businesses Contest (“Contest”) is sponsored by OfficeMax Incorporated (“Sponsor”). The Contest begins at or around 10:00:00 a.m. Central Time (“CT”) on November 18, 2013, and ends at or around 11:59:59 p.m. CT on December 24, 2014 (the “Contest Period”). Eligible participants may enter the Contest in one of two ways: as an individual or as part of a Team (defined below). Participants may enter the Contest by creating a Video Submission (defined below) and submitting it as part of an Entry via the Contest Site (both terms defined below), as more fully described below. Three (3) Entries will be selected as the winners through a two-step evaluation process. First, all eligible Entries will be posted on the Contest Site. The Contest Site will include functionality that allows users to share an Entry (or link thereto) with others on social media. At the close of the Contest Period, the ten (10) Entries with the greatest number of completed “shares” will move onto the second stage of the winner-selection process. In the second stage, each of the eligible Entries will be reviewed and evaluated by a Sponsor-selected panel of Judges (defined below) who will select one (1) grand-prize winning Entry, one (1) first-prize winner Entry, and one (1) second-prize winning Entry in accordance with the process described in the “Winner Selection” section, below.

There may be other contests that are similar to this one being run at the same time by Sponsor, including, without limitation, the OfficeMax Elf Yourself: “Groove Your Inner Elf” for Individuals Contest. Entry into this Contest does not constitute entry into any other. YOU MAY NOT ENTER THIS CONTEST USING A VIDEO SUBMISSION (DEFINED BELOW) THAT YOU PREVIOUSLY USED TO ENTER INTO THE OFFICEMAX ELF YOURSELF: “GROOVE YOUR INNER ELF” FOR INDIVIDUALS CONTEST, NOR MAY YOU ENTER THIS CONTEST AS PART OF A TEAM THE MEMBERSHIP OF WHICH IS IDENTICAL TO A TEAM WITH WHICH YOU HAVE ENTERED THE OFFICEMAX ELF YOURSELF: “GROOVE YOUR INNER ELF” FOR INDIVIDUALS CONTEST.

ELIGIBILITY:

This Contest may only be entered by legal residents of any one (1) of the fifty (50) United States or the District of Columbia who are at least eighteen (18) years of age and the age of majority in their state or jurisdiction of residence as of the date of entry. Employees, officers, directors, members, managers, agents, and representatives and family members of such individuals (or people living in the same household whether related or not) of Sponsor, Social Media Gateways, Inc., and their respective corporate partners, parent companies, divisions, subsidiaries, affiliates, and successors in interest, each of their advertising, promotion and public relations agencies, and any other party participating in the development, design, administration, or fulfillment of this Contest (collectively the “Released Parties”) are not eligible. For purposes of this Contest, family members are defined as spouse, partner, mother, father, legal guardian, in-laws, grandmother, grandfather, brother, sister, children, and grandchildren. Participation in this Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor.

TO ENTER (complete the following 3 steps):

(a) Decide to Whether to Participate as an Individual or a Team: Eligible participants must first determine whether they will participate as an individual or a “Team.” A Team must consist of between two (2) and five (5) members, all of whom must be employed by the same employer or partners in the same commercial venture (either a “Business”). If the applicable Business is sufficiently large that it is internally subdivided into departments or divisions (“Department”), all members of the Team must work in the same Department. If that Department of the Business operates from more than one physical location (each an “Office”), all members of the Team must work in the same Office. Each member of a Team must meet the Eligibility requirements described above and must read and agree to these Official Rules. For the purposes of these Official Rules, each member of a Team will be considered an “entrant,” as applicable. Sponsor will not be responsible for any Team-related disputes, including, without limitation, disputes regarding Team membership or ownership of any intellectual-property rights members may have in your Team’s Video Submission (defined below).

(b) Create Your Video Submission: Eligible individual or Team entrants must create and submit a video (the “Video Submission”) in which the individual entrant or members of the Team perform a creative interpretation of the “Elf Yourself Office Party” dance (each an “EY Dance”) demonstrated in the video on Sponsor’s Elf Yourself website, http://www.elfyourself.com (the “Elf Yourself Site”). (Note that there are several “Elf Yourself” dance videos on the Elf Yourself Site. For the purposes of this Contest, you must use the “Office Party” version as the inspiration for your Video Submission). In the Video Submission, you or your Team (as applicable) should perform your own creative interpretation of the EY Dance, while attempting to capture the spirit of the original. During the Contest Period, Sponsor will make the music for the EY Dance available for download from the Contest Site. Your Video Submission must be set to the music for the EY Dance. All Video Submissions must comply with the “Submission Requirements” detailed below and otherwise comply with these Official Rules. Compliant Entries received during the Contest Period will be evaluated, as more fully detailed in the “Winner Selection” section below. Use of the music provided for creation of the Video Submission for purposes other than creation of the Video Submission is prohibited.

(c) Submit an Entry: During the Contest Period, eligible participants can enter the Contest by visiting http://www.officemax.com/officepartycontest (the “Contest Site”) and following the on-screen links and instructions on the Contest Site to complete and submit the Contest entry form, (an “Entry” or, collectively, “Entries”), including uploading your Video Submission. To submit an Entry, you must provide all information required by the Contest entry form. For those entering as an individual, this will include, without limitation, your first and last name, the name of your Business, mailing address for your office location, name of your Department in the Business (if applicable), your Business email address, your daytime phone number (including area code), and your date of birth. For those entering as a Team, this will include, without limitation, the chosen name of your Team, the name of your Business, mailing address of your office location, name of your Department in the Business (if applicable), the first and last name of each Team member, the date of birth of each Team member, the Business email address of the Team member submitting the Entry, and the phone number (including area code) of the Team member submitting the Entry. The Team member who submits an Entry will be deemed the Team leader and Sponsor will only communicate with the Team leader for any communications necessary for this Contest. Entries must be submitted during the Contest Period and in strict accordance with the instructions and restrictions on the Contest Site and these Official Rules.

LIMIT ONE (1) ENTRY PER PERSON AND PER EMAIL ADDRESS. You may not submit an Entry both individually and as part of a Team, nor may you be a member of more than one (1) Team. If you are participating in the Contest as part of a Team, only one (1) Team member can submit an Entry. Multiple Entries including the same Video Submission are prohibited. The Contest Site’s database clock will be the official timekeeper for this Contest. Only Entries that are recorded on the Contest Site’s servers will be considered. Other proof of submitting or attempting to submit an Entry (such as, without limitation, a printed, saved or copied automated receipt confirming entry or a “thanks for entering” screen or message) does not constitute proof of actual receipt of the Entry for purposes of this Contest. Those who do not abide by these Official Rules or the instructions of Sponsor or its representatives and provide all required information may, in Sponsor’s sole discretion, be disqualified and all Entries by such person voided. Entries (or submission of other materials that do not qualify as an Entry) will not be acknowledged or returned. Entries that are forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, incomprehensible, garbled, or generated by a macro, bot, or other automated means will not be accepted and will be void. Entries or participation made on behalf of any other individual or any entity or group (other than by a Team leader on behalf of his or her Team), or originating at any web site other than the Contest Site, including, without limitation, through commercial promotion subscription notification or entering services, will be declared invalid and disqualified for this Contest. As a condition of entering the Contest, without limiting any other provision in these Official Rules, each entrant gives consent for Sponsor and its agents to obtain and deliver his or her name, address and other information and content to third parties for the purpose of administering this Contest and complying with applicable laws, regulations, and rules. ENTRIES WILL NOT BE ACKNOWLEDGED OR RETURNED AND, IN FACT, MAY BE DESTROYED. YOU SHOULD RETAIN A BACK-UP COPY OF YOUR VIDEO SUBMISSION. ANY ENTRY OR VIDEO SUBMISSION THAT DOES NOT CONFORM TO THE REQUIREMENTS IN THESE OFFICIAL RULES MAY, IN SPONSOR’S SOLE DISCRETION, BE DEEMED INELIGIBLE.

SUBMISSION REQUIREMENTS:

Each Video Submission must meet all of the following requirements, as determined by Sponsor in its sole discretion, or the associated Entry may be disqualified:

Video Submissions must be no more than 1:05 minutes long and in one of the following formats: mp4, m4v, mov, m2v, 3gp, avi, mpeg.
• .
• Video Submissions must not be filmed at a location where doing so is prohibited by law, contract or policy.
• All aspects of the Video Submission must be originally created by and solely owned by you (or, if applicable, your Team) or be in the public domain. All third-party content and content not original to you (unless it is in the public domain) is prohibited, except for the choreography and music for the EY Dance (“Sponsor IP”). Sponsor grants each entrant a non-exclusive, revocable (at any time in Sponsor’s sole discretion) license to use the Sponsor IP for the sole purpose of creating a Video Submission and entering this Contest.
• If any part of the Video Submission depicts or includes any third party, entrant must have all permissions and rights from the individual depicted and agrees to provide Sponsor with written confirmation of those permissions and rights upon request.
• Only the individual entrant or, if applicable, Team members may appear in a Video Submission.
• Video Submissions must not create or imply any association between Sponsor and any individual, entity, or anyone else or his, her, or its products or services including, without limitation, those of your Business
• Video Submissions must NOT identify, reference, or depict any company or any company’s brands, products, or services, including, without limitation, your Business.
• Video Submissions must NOT contain any commercial or corporate advertising (including, without limitation, corporate logos, brand names, and slogans) or reference to recognizable branded products, including, without limitation, those of your Business.
• Video Submission must NOT include any music except for the EY Dance music provided by Sponsor.
• Video Submissions must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright (including moral rights), trademark, trade secret, or right of privacy or publicity.
• Video Submissions must be unpublished and not have been submitted in any other contest, promotion, or competition including, without limitation, in the OfficeMax Elf Yourself: “Groove Your Inner Elf” for Individuals Contest.
• Video Submissions must not include information or content that is false, fraudulent, deceptive, misleading, defamatory, threatening, trade libelous, slanderous, libelous, disparaging, unlawfully harassing, profane, obscene, pornographic, hateful, indecent, inappropriate or injurious to any individual, any Released Party, or any third party.
• Video Submissions must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local law, rule, or regulation.
• Video Submissions must be suitable for presentation in a public forum.
• Video Submissions must not suggest, depict, or describe any inappropriate, unlawful behavior or use of Sponsor’s or any other products or services.
• Each entrant agrees that his/her participation in the Contest and agreement to these Official Rules and any Released Party’s display and use of his/her Video Submission will not violate any agreement to which entrant is a signatory or party.
• Entrant agrees to indemnify the Released Parties against any and all claims from any third party for any use or reuse by any Released Party of the Video Submission.

Sponsor reserves the right in its sole discretion to disqualify from the Contest and/or cease or refrain from displaying or publishing any Entry or Video Submission that, in its sole discretion, refers, depicts, or in any way reflects negatively upon a Released Party, the Contest, or any other person or entity or does not comply with these Submission Requirements or any other requirement of these Official Rules.

WINNER SELECTION/NOTIFICATION:

One (1) grand-prize winning Entry, one (1) first-prize winning Entry, and one (1) second-prize winning Entry will be selected as the potential winning Entries through a two-step evaluation process.

First, during the Contest Period, all eligible Entries will be posted on the Contest Site. The Contest Site will include functionality that allows users to share an Entry with others via select social-media platforms. Sponsor will maintain an accounting of the number of times each Entry is shared by visitors to the Contest Site during the Contest Period (each a “Share”). Each visitor to the Contest Site will only be permitted to Share a given Entry one (1) time during each day. Entrants are prohibited from obtaining Shares by any fraudulent or inappropriate means, as determined by the Sponsor in its sole discretion, including, without limitation, by offering prizes or other inducements in exchange for Shares. Use of these techniques, or of any script, macro, or other automated or artificial system to Share, or acting in any manner with the intent or effect of impairing the integrity of the sharing process, is prohibited and all such Shares will, upon discovery by the Sponsor, be deemed null and void and may lead to the disqualification of the applicable entrant. At the close of the Contest Period, the ten (10) Entries with the greatest number of Shares will move onto the second stage of the winner-selection process.

In the second stage, each eligible Entry will be evaluated by a panel of judges who will be selected by Sponsor in its sole discretion (the “Judges”). The Judges will score each Entry based on the following criteria according to the percentage weights indicated: creativity (34%), extent to which the Video Submission captured the spirit of the EY Dance (33%), and entertainment value (33%) (collectively the “Criteria”). The one (1) Entry with the highest score will be named the potential grand-prize winner; the one (1) Entry with the next highest score will be named the potential first-prize winner; and the one (1) Entry with the third-highest score will be named the potential second-prize winner. In the event of a tie in the selection of any winner, the entrant with the higher score on the creativity Criterion will be named the winner. If there is still a tie, the tie will be broken by naming as the winner the entrant with the higher score on the “spirit” Criterion.

The Judges’ decisions will be rendered within approximately five (5) business days of the end of the Contest Period. Sponsor reserves the right to contact participants for verification purposes and administration of the Contest. All Judges’ decisions are final and binding in all matters relating to this Contest. Each entrant acknowledges that other entrants may have created ideas and concepts contained in their Video Submissions that may have familiarities or similarities to his/her Video Submission, and that he/she will not be entitled to any compensation or right to negotiate with the Sponsor because of these familiarities or similarities. Following the Judges’ decision, Sponsor or its representative will attempt to notify the potential winner within approximately five (5) business days of the determination of potential winners by the Judges. Sponsor may attempt to contact potential winners by email, telephone, or mail at its discretion.

The potential prize winner or each member of a potentially winning Team (if applicable) may, in Sponsor's sole discretion, be required to complete, sign, have notarized (if applicable), and return an Affidavit of Eligibility and Liability/Publicity Release (unless prohibited by law) (collectively, “Winner Documents”) within the time frame specified and in the form provided by Sponsor, without revision, or prize may be forfeited. The Winner Documents, if applicable, must be received by Sponsor from the potential winner (including, if applicable, all members of a potentially winning Team) within five (5) days of Sponsor sending the documents to the potential winner or other time frame as stated in the Winner Documents, or prize may be forfeited and an alternate winner may be selected. If any prize, prize notification, or other Contest-related communication is returned as undeliverable, or if a selected potential winner cannot be reached or does not respond as instructed after Sponsor has attempted to notify that potential winner, that selected winner may be disqualified and an alternate winner may be selected (time permitting and in Sponsor’s sole discretion). Sponsor reserves the right to modify the notification procedures in connection with the selection of any alternate potential winner, if any. The prize claim and Winner Documents are subject to verification by Sponsor. The prizes, if legitimately claimed, will be awarded. Sponsor will not be obligated to pursue more than three (3) alternate winners (time permitting) for any prize for any reason. The Business that employs the winner may, in Sponsor’s sole discretion, be required to execute certain prize acceptance and related documents or prize may be forfeited.

PRIZES, QUANTITY & APPROXIMATE RETAIL VALUE (“ARV”):

Subject to verification, the prizes in this Contest will be awarded to the Business that employs the respective winner or winning Team or, if applicable, to the Department or Office of the Business that employs the respective winner or winning Team. No individual entrant or Team member wins any prize in this Contest.

Grand Prize: Subject to verification, one (1) grand-prize package will be awarded to the Business that employs the grand-prize winner or winning Team or, if applicable and as determine by Sponsor, to the Department or Office of the Business that employs the grand-prize winner or winning Team. First Prize: Subject to verification, one (1) first-prize package will be awarded to the Business that employs the first-prize winner or winning Team or, if applicable and as determined by Sponsor, to the Department or Office of the Business that employs the first-prize winner or winning Team. The first prize package consists solely of the following: one (1) month of premium payroll services from Company.com for up to twelve (12) employees [expires Feb 1 2015] a one-year (1-year) subscription for one (1) user to McAfee LiveSafe [expires Feb 1 , 2015] one (1) Dell Venue 8 Pro Tablet (configuration determined by Sponsor in its sole discretion); one (1) Dell monochrome laser printer; and one (1) WorkPro chair. The ARV of the first-prize package is $1,599.00

Second Prize: Subject to verification, one (1) second-prize package will be awarded to the Business that employs the second-prize winner or winning Team or, if applicable and as determined by Sponsor, to the Department or Office of the Business that employs the second-prize winner or winning Team. The second prize package consists solely of the following: one (1) month of premium payroll services from Company.com for up to twelve (12) employees [expires Feb 1, 2015] a one-year (1-year) subscription for one (1) user to McAfee LiveSafe [expires Feb 1, 2015] one (1) Dell Venue 8 Pro Tablet (configuration determined by Sponsor in its sole discretion); one (1) Dell monochrome laser printer; and one (1) WorkPro chair. The ARV of the second-prize package is $1,599.00

The total ARV of all prizes offered in this Contest is $24,067.61

Awarding of the prizes in this Contest is subject to any applicable corporate policy (e.g., corporate gift receiving policy). Sponsor is not responsible for any inability of the Business that employs any winner to accept or use any prize (or portion thereof) for any reason, including, without limitation, where acceptance of the prize would violate any corporate or similar policy.

Prize details not specifically stated in these Official Rules will be determined by Sponsor in its sole discretion. Prize elements will only be mailed to winner’s Business address in one (1) of the fifty (50) United States or the District of Columbia. All federal, state, and local taxes, as well as any expenses arising from acceptance or use of the prize and not specified in these Official Rules as being provided as part of the prize, are the sole responsibility of the Business that employs the winner. Sponsor is not responsible for and will not replace any lost, mutilated or stolen prize or prize element or any prize that is undeliverable or does not reach a winner or his/her Business because of incorrect or changed contact information. If a Business does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and Sponsor will have no further obligation with respect to that prize or portion of the prize. No transfers, prize substitutions, or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the stated prize or any component thereof with another prize or component of equal or greater value for any reason, including, without limitation, prize unavailability. No more than the stated prizes will be awarded. Entrants waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption and any liability and publicity which might arise from claiming or seeking to claim said prize.

LICENSE:

By entering, except where prohibited by law, each entrant grants to the Released Parties and their agents, successors and assigns in perpetuity the irrevocable, sublicensable, absolute right and permission to use, edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, separate, dub, adapt, publish, combine with other material, reuse, adapt, and exploit the content of and elements embodied in the Video Submission and Entry, and the Video Submission and Entry themselves, in any and all media (including but not limited to audiovisual, digital, and electronic media), whether now existing or hereafter devised, in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation. Each entrant agrees that the licensed entities may, but are not required to, attribute the Video Submission to entrant. Each entrant waives and releases the Released Parties from any and all claims that entrant may now or hereafter have in any jurisdiction based on “moral rights” or “droit moral” or unfair competition with respect to the Released Parties’ exploitation of Entries without further notification or compensation to participants of any kind, and agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Released Parties and each of their affiliates, licensees, or any other person in connection with this Contest, on the grounds that any use of any Video Submission or Entry, or any derivative works, infringe or violate any of participant’s rights (including MORAL RIGHTS) therein.

Each entrant acknowledges and agrees that nothing in these Official Rules will require a Released Party to use the Video Submission in part or in whole or to include the Video Submission in any Released Party-related property, including, without limitation, any Released Party’s web site or any other online or offline property. Each entrant hereby acknowledges and agrees that the relationship between the entrant and any of the Released Parties is not a confidential, fiduciary, or other special relationship, and that the entrant’s decision to submit his/her Video Submission for purposes of the Contest does not place any of the Released Parties in a position that is any different from the position held by members of the general public with regard to elements of the Video Submission, other than as set forth in these Official Rules. Each entrant understands and acknowledges that Sponsor has wide access to ideas and other artistic materials. Each entrant also acknowledges that many ideas or stories may be competitive with, similar to, or identical to his/her Video Submission and/or each other in idea, components, format, or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material that has or may come to Sponsor from other sources. Each entrant acknowledges and agrees that Sponsor does not now and will not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the entrant’s copyright in and to his/her Video Submission, if any. Each entrant acknowledges that, with respect to any claim by participant relating to or arising out of a Released Party’s actual or alleged exploitation or use of any Video Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition, or other exploitation of any Released Party property or production, and entrant’s rights and remedies in any such event are strictly limited to the right to recover damages, if any, in an action at law.

LIMITATION OF LIABILITY:

EACH ENTRANT AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY THE RELEASED PARTIES FROM ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE ACCEPTANCE, POSSESSION, USE, MISUSE OR AWARDING OF THE PRIZE OR ANY PRIZE ELEMENT OR WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE- OR CONTEST-RELATED ACTIVITY INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY. EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES OR PARTICIPATING ELIGIBLE COUNTRY ARE HEREBY EXPRESSLY WAIVED BY HIM/HER AGAINST THE RELEASED PARTIES. SECTION 1542 READS AS FOLLOWS:

“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

ADDITIONAL DISCLAIMERS: Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, the entrant or by human error: Entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or Entries in excess of the stated limit; any lost, late, incomplete, illegible, mutilated, or misdirected Entries, e-mail, mail, or Contest-related correspondence or materials or postage-due mail; any error, omission, interruption, defect, or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos or misprints in these Official Rules, in any Contest-related advertisements, or other materials; failures of electronic equipment, computer hardware or software; lost or unavailable network connections, or failed, incorrect, incomplete, incomprehensible, inaccurate, garbled or delayed electronic communications or entry information. Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s e-mail account to receive e-mail messages. Released Parties are not responsible, and may disqualify an entrant, if his or her e-mail address, telephone, or other contact information does not work or is changed without entrant giving prior written notice to Sponsor. Without limiting any other provision in these Official Rules, Released Parties are not responsible or liable to any entrant or winner or any person claiming through such entrant or winner for failure to supply the prize or any part thereof in the event that any of the Contest activities or the Released Parties’ operations or activities are affected, as determined by the Sponsor in its sole discretion, including, without limitation, by reason of any acts of God, any law, rule, regulation, action, order, or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), blackout, earthquake, fire, flood, epidemic, explosion, unusually severe weather, or hurricane; embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause, whether or not specifically mentioned above.

GENERAL RULES: By entering the Contest (except where prohibited by law), each entrant grants the Released Parties the irrevocable, sublicensable, absolute right and permission to use, publish, post or display his or her name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to him or her and any other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Released Parties’ sole discretion) for advertising, trade, promotional and publicity purposes, without further obligation or compensation of any kind to him or her, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), worldwide, without any limitation of time and without notice, review, or approval and each entrant releases all Released Parties from any and all liability related thereto. Nothing contained in these Official Rules obligates Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use.

Sponsor’s decisions will be final in all matters relating to this Contest, including interpretation of these Official Rules, accounting of valid Shares, selection of the winner, and awarding of the prize. All participants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Failure to comply with these Official Rules may result in disqualification from this Contest. Participants further agree to not damage or cause interruption of the Contest and/or prevent others from participating in or engaging with the Contest. Sponsor reserves the right to restrict or void Entries, Shares, or other participation from any IP address if any suspicious entry, Share, and/or participation is detected. Sponsor reserves the right, in its sole discretion, to void Entries of any entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Contest, including, without limitation, interfering (directly or indirectly), with the integrity of the Share mechanism. Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency within these Official Rules), it will be resolved in Sponsor’s sole discretion. Entrants waive any right to claim ambiguity in the Contest or these Official Rules. If Sponsor determines at any time in its sole discretion that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. If the Contest is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest and award the prize from eligible Entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains Entries or Shares by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law. In the event of a dispute concerning the identity of a participant who enters using the Contest Site, the participant will be declared to be the registered account holder of the e-mail address submitted with the Entry, but only if that person meets all other eligibility criteria, otherwise the Entry may, in Sponsor’s sole discretion, be disqualified and any potential prize won will be forfeited. A registered account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be required to provide Sponsor with proof that he/she is the registered account holder of the e-mail address associated with the potentially winning entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the Entry will be deemed ineligible. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST VIOLATES CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

DISPUTES/GOVERNING LAW:

Except where prohibited, as a condition of participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the entrant and any Released Party, claims and causes of action arising out of or connected with this Contest, or the prize awarded, or the determination of the winners must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (if any), not to exceed ten U.S. dollars ($10 USD), and entrant further waives all rights to have damages multiplied or increased.

This Contest and any dispute arising under or related thereto (whether for breach of contract, tortious conduct or otherwise) will be governed by the laws of the State of Illinois, without reference to its conflicts of law principles. Any legal actions, suits or proceedings related to this Contest (whether for breach of contract, tortious conduct or otherwise) will be brought exclusively in the state or federal courts located in or having jurisdiction over DuPage County, Illinois and each entrant accepts and submits to the personal jurisdiction of these Illinois courts with respect to any legal actions, suits, or proceedings arising out of or related to this Contest.

OVERVIEW:

The OfficeMax Elf Yourself: “Groove Your Inner Elf” for Individuals Contest (“Contest”) is sponsored by OfficeMax Incorporated (“Sponsor”). The Contest begins at or around 10:00:00 a.m. Central Time (“CT”) on November 18, 2013, and ends at or around 11:59:59 p.m. CT on December 24, 2014 (the “Contest Period”). Eligible participants may enter the Contest in one of two ways: as an individual or as part of a Team (defined below). Participants may enter the Contest by creating a Video Submission (defined below) and submitting it as part of an Entry via the Contest Site (both terms defined below), as more fully described below. Three (3) Entries will be selected as the winner through a two-step evaluation process. First, all eligible Entries will be posted on the Contest Site. The Contest Site will include functionality that allows users to share an Entry (or link thereto) with others on social media. At the close of the Contest Period, the ten (10) Entries with the greatest number of completed “shares” will move onto the second stage of the winner-selection process. In the second stage, each of the eligible Entries will be reviewed and evaluated by a Sponsor-selected panel of Judges (defined below) who will select one (1) grand-prize winning Entry, one (1) first-prize winner Entry, and one (1) second-prize winning Entry in accordance with the process described in the “Winner Selection” section, below.

There may be other contests that are similar to this one being run at the same time by Sponsor, including, without limitation, the OfficeMax Elf Yourself: “Groove Your Inner Elf” for Businesses Contest. Entry into this Contest does not constitute entry into any other. YOU MAY NOT ENTER THIS CONTEST USING A VIDEO SUBMISSION (DEFINED BELOW) THAT YOU PREVIOUSLY USED TO ENTER INTO THE OFFICEMAX ELF YOURSELF: “GROOVE YOUR INNER ELF” FOR BUSINESSES CONTEST, NOR MAY YOU ENTER THIS CONTEST AS PART OF A TEAM THE MEMBERSHIP OF WHICH IS IDENTICAL TO A TEAM WITH WHICH YOU HAVE ENTERED THE OFFICEMAX ELF YOURSELF: “GROOVE YOUR INNER ELF” FOR BUSINESSES CONTEST.

ELIGIBILITY:

This Contest may only be entered by legal residents of any one (1) of the fifty (50) United States or the District of Columbia who are at least eighteen (18) years of age and the age of majority in their state or jurisdiction of residence as of the date of entry. Employees, officers, directors, members, managers, agents, and representatives and family members of such individuals (or people living in the same household whether related or not) of Sponsor, Social Media Gateways, Inc., and their respective corporate partners, parent companies, divisions, subsidiaries, affiliates, and successors in interest, each of their advertising, promotion and public relations agencies, and any other party participating in the development, design, administration, or fulfillment of this Contest (collectively the “Released Parties”) are not eligible. For purposes of this Contest, family members are defined as spouse, partner, mother, father, legal guardian, in-laws, grandmother, grandfather, brother, sister, children, and grandchildren. Participation in this Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor.

TO ENTER (complete the following 3 steps):

(a) Decide to Whether to Participate as an Individual or a Team: Eligible participants must first determine whether they will participate as an individual or a “Team.” A Team must consist of between two (2) and five (5) members, all of whom must be employed by the same employer or partners in the same commercial venture (either a “Business”). Each member of a Team must meet the Eligibility requirements described above and must read and agree to these Official Rules. For the purposes of these Official Rules, each member of a Team will be considered an “entrant,” as applicable. Sponsor will not be responsible for any Team-related disputes, including, without limitation, disputes regarding Team membership, ownership of any intellectual-property rights members may have in your Team’s Video Submission (defined below), or division of prize components among members of a winning Team.

(b) Create Your Video Submission: Eligible individual or Team entrants must create and submit a video (the “Video Submission”) in which the individual entrant or members of the Team perform a creative interpretation of the “Elf Yourself Office Party” dance (each an “EY Dance”) demonstrated in the video on Sponsor’s Elf Yourself website, http://www.elfyourself.com (the “Elf Yourself Site”). (Note that there are several “Elf Yourself” dance videos on the Elf Yourself Site. For the purposes of this Contest, you must use the “Office Party” version as the inspiration for your Video Submission). In the Video Submission, you or your Team (as applicable) should perform your own creative interpretation of the EY Dance, while attempting to capture the spirit of the original. During the Contest Period, Sponsor will make the music for the EY Dance available for download from the Contest Site. Your Video Submission must be set to the music for the EY Dance. All Video Submissions must comply with the “Submission Requirements” detailed below and otherwise comply with these Official Rules. Compliant Entries received during the Contest Period will be evaluated, as more fully detailed in the “Winner Selection” section below. Use of the music provided for creation of the Video Submission for purposes other than creation of the Video Submission is prohibited.

(c) Submit an Entry: During the Contest Period, eligible participants can enter the Contest by visiting http://www.officemax.com/officepartycontest (the “Contest Site”) and following the on-screen links and instructions on the Contest Site to complete and submit the Contest entry form, (an “Entry” or, collectively, “Entries”), including uploading your Video Submission. To submit an Entry, you must provide all information required by the Contest entry form. For those entering as an individual, this will include, without limitation, your first and last name, your mailing address, your email address, your daytime phone number (including area code), and your date of birth. For those entering as a Team, this will include, without limitation, the chosen name of your Team, your mailing address, the first and last name of each Team member, the date of birth of each Team member, the email address of the Team member submitting the Entry, and the phone number (including area code) of the Team member submitting the Entry. The Team member who submits an Entry will be deemed the Team leader and Sponsor will only communicate with the Team leader for any communications necessary for this Contest. Entries must be submitted during the Contest Period and in strict accordance with the instructions and restrictions on the Contest Site and these Official Rules.

LIMIT ONE (1) ENTRY PER PERSON, PER HOUSEHOLD, AND PER EMAIL ADDRESS. You may not submit an Entry both individually and as part of a Team, nor may you be a member of more than one (1) Team. If you are participating in the Contest as part of a Team, only one (1) Team member can submit an Entry. Multiple Entries including the same Video Submission are prohibited. The Contest Site’s database clock will be the official timekeeper for this Contest. Only Entries that are recorded on the Contest Site’s servers will be considered. Other proof of submitting or attempting to submit an Entry (such as, without limitation, a printed, saved or copied automated receipt confirming entry or a “thanks for entering” screen or message) does not constitute proof of actual receipt of the Entry for purposes of this Contest. Those who do not abide by these Official Rules or the instructions of Sponsor or its representatives and provide all required information may, in Sponsor’s sole discretion, be disqualified and all Entries by such person voided. Entries (or submission of other materials that do not qualify as an Entry) will not be acknowledged or returned. Entries that are forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, incomprehensible, garbled, or generated by a macro, bot, or other automated means will not be accepted and will be void. Entries or participation made on behalf of any other individual or any entity or group (other than by a Team leader on behalf of his or her Team), or originating at any web site other than the Contest Site, including, without limitation, through commercial promotion subscription notification or entering services, will be declared invalid and disqualified for this Contest. As a condition of entering the Contest, without limiting any other provision in these Official Rules, each entrant gives consent for Sponsor and its agents to obtain and deliver his or her name, address and other information and content to third parties for the purpose of administering this Contest and complying with applicable laws, regulations, and rules. ENTRIES WILL NOT BE ACKNOWLEDGED OR RETURNED AND, IN FACT, MAY BE DESTROYED. YOU SHOULD RETAIN A BACK-UP COPY OF YOUR VIDEO SUBMISSION. ANY ENTRY OR VIDEO SUBMISSION THAT DOES NOT CONFORM TO THE REQUIREMENTS IN THESE OFFICIAL RULES MAY, IN SPONSOR’S SOLE DISCRETION, BE DEEMED INELIGIBLE.

Video Submissions must be less than 64MB, no more than1:05 minutes long and in one of the following formats: mp4, m4v, mov, m2v, 3gp, avi, mpeg.

• Video Submissions must not be filmed at a location where doing so is prohibited by law, contract or policy.
• All aspects of the Video Submission must be originally created by and solely owned by you (or, if applicable, your Team) or be in the public domain. All third-party content and content not original to you (unless it is in the public domain) is prohibited, except for the choreography and music for the EY Dance (“Sponsor IP”). Sponsor grants each entrant a non-exclusive, revocable (at any time in Sponsor’s sole discretion) license to use the Sponsor IP for the sole purpose of creating a Video Submission and entering this Contest.
• If any part of the Video Submission depicts or includes any third party, entrant must have all permissions and rights from the individual depicted and agrees to provide Sponsor with written confirmation of those permissions and rights upon request.
• Only the individual entrant or, if applicable, Team members may appear in a Video Submission.
• Video Submissions must not create or imply any association between Sponsor and any individual, entity, or anyone else or his, her, or its products or services including, without limitation, those of your Business
• Video Submissions must NOT identify, reference, or depict any company or any company’s brands, products, or services, including, without limitation, your Business.
• Video Submissions must NOT contain any commercial or corporate advertising (including, without limitation, corporate logos, brand names, and slogans) or reference to recognizable branded products, including, without limitation, those of your Business.
• Video Submission must NOT include any music except for the EY Dance music provided by Sponsor.
• Video Submissions must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright (including moral rights), trademark, trade secret, or right of privacy or publicity.
• Video Submissions must be unpublished and not have been submitted in any other contest, promotion, or competition, including, without limitation, in the OfficeMax Elf Yourself: “Groove Your Inner Elf” for Businesses Contest.
• Video Submissions must not include information or content that is false, fraudulent, deceptive, misleading, defamatory, threatening, trade libelous, slanderous, libelous, disparaging, unlawfully harassing, profane, obscene, pornographic, hateful, indecent, inappropriate or injurious to any individual, any Released Party, or any third party.
• Video Submissions must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local law, rule, or regulation.
• Video Submissions must be suitable for presentation in a public forum.
• Video Submissions must not suggest, depict, or describe any inappropriate, unlawful behavior or use of Sponsor’s or any other products or services.
• Each entrant agrees that his/her participation in the Contest and agreement to these Official Rules and any Released Party’s display and use of his/her Video Submission will not violate any agreement to which entrant is a signatory or party.
• Entrant agrees to indemnify the Released Parties against any and all claims from any third party for any use or reuse by any Released Party of the Video Submission.

Sponsor reserves the right in its sole discretion to disqualify from the Contest and/or cease or refrain from displaying or publishing any Entry or Video Submission that, in its sole discretion, refers, depicts, or in any way reflects negatively upon a Released Party, the Contest, or any other person or entity or does not comply with these Submission Requirements or any other requirement of these Official Rules.

WINNER SELECTION/NOTIFICATION:

One (1) grand-prize winning Entry, one (1) first-prize winning Entry, and one (1) second-prize winning Entry will be selected as the potential winning Entries through a two-step evaluation process.

First, during the Contest Period, all eligible Entries will be posted on the Contest Site. The Contest Site will include functionality that allows users to share an Entry with others via select social-media platforms. Sponsor will maintain an accounting of the number of times each Entry is shared by visitors to the Contest Site during the Contest Period (each a “Share”). Each visitor to the Contest Site will only be permitted to Share a given Entry one (1) time during each day. Entrants are prohibited from obtaining Shares by any fraudulent or inappropriate means, as determined by the Sponsor in its sole discretion, including, without limitation, by offering prizes or other inducements in exchange for Shares. Use of these techniques, or of any script, macro, or other automated or artificial system to Share, or acting in any manner with the intent or effect of impairing the integrity of the sharing process, is prohibited and all such Shares will, upon discovery by the Sponsor, be deemed null and void and may lead to the disqualification of the applicable entrant. At the close of the Contest Period, the ten (10) Entries with the greatest number of Shares will move onto the second stage of the winner-selection process.

In the second stage, each eligible Entry will be evaluated by a panel of judges who will be selected by Sponsor in its sole discretion (the “Judges”). The Judges will score each Entry based on the following criteria according to the percentage weights indicated: creativity (34%), extent to which the Video Submission captured the spirit of the EY Dance (33%), and entertainment value (33%) (collectively the “Criteria”). The one (1) Entry with the highest score will be named the potential grand-prize winner; the one (1) Entry with the next highest score will be named the potential first-prize winner; and the one (1) Entry with the third-highest score will be named the potential second-prize winner. In the event of a tie in the selection of any winner, the entrant with the higher score on the creativity Criterion will be named the winner. If there is still a tie, the tie will be broken by naming as the winner the entrant with the higher score on the “spirit” Criterion.

The Judges’ decisions will be rendered within approximately five (5) business days of the end of the Contest Period. Sponsor reserves the right to contact participants for verification purposes and administration of the Contest. All Judges’ decisions are final and binding in all matters relating to this Contest. Each entrant acknowledges that other entrants may have created ideas and concepts contained in their Video Submissions that may have familiarities or similarities to his/her Video Submission, and that he/she will not be entitled to any compensation or right to negotiate with the Sponsor because of these familiarities or similarities. Following the Judges’ decision, Sponsor or its representative will attempt to notify the potential winner within approximately five (5) business days of the determination of potential winners by the Judges. Sponsor may attempt to contact potential winners by email, telephone, or mail at its discretion.

Each potential prize winner or each member of a potentially winning Team (if applicable) may, in Sponsor's sole discretion, be required to complete, sign, have notarized (if applicable), and return an Affidavit of Eligibility and Liability/Publicity Release (unless prohibited by law) and tax documents, if applicable (collectively, “Prize Winner Documents”), any or all of which may require the potential winner to provide his or her Social Security Number, and a copy of a government-issued identification or number therefrom, within the time frame specified and in the form provided by Sponsor, without revision, or prize may be forfeited. The Prize Winner Documents, if applicable, must be received by Sponsor from the potential winner (including, if applicable, all members of a potentially winning Team) within five (5) days of Sponsor sending the documents to the potential winner or other time frame as stated in the Prize Winner Documents, or prize may be forfeited and an alternate winner may be selected. If any prize, prize notification, or other Contest-related communication is returned as undeliverable, or if a selected potential winner cannot be reached or does not respond as instructed after Sponsor has attempted to notify that potential winner, that selected winner may be disqualified and an alternate winner may be selected (time permitting and in Sponsor’s sole discretion). Sponsor reserves the right to modify the notification procedures in connection with the selection of any alternate potential winner, if any. The prize claim and Prize Winner Documents are subject to verification by Sponsor. The prizes, if legitimately claimed, will be awarded. Sponsor will not be obligated to pursue more than three (3) alternate winners (time permitting) for any prize for any reason.

Prizes awarded to a winning Team will not multiplied by the number of Team members. It is up to the Team to determine prize distribution. Sponsor will not be liable and will not be obligated to settle any disputes among Team members. If a Team attempts to bring Sponsor into a dispute associated with a prize won by a Team, Sponsor reserves the right to deem that winning Team ineligible and award the prizes won to an alternate winner.

Awarding of the prize in this Contest is subject to any applicable corporate policy (e.g., corporate gift receiving policy). Sponsor is not responsible for any inability of any winner to accept or use any prize (or portion thereof) for any reason, including, without limitation, where acceptance of the prize would violate any corporate or similar policy to which the winner is subject.

Prize details not specifically stated in these Official Rules will be determined by Sponsor in its sole discretion. Prize elements will only be mailed to winner’s address in one (1) of the fifty (50) United States or the District of Columbia (or, if the winner is a Team, to the address of the Team leader). All federal, state, and local taxes, as well as any expenses arising from acceptance or use of the prize and not specified in these Official Rules as being provided as part of the prize, are the sole responsibility of the winner. Sponsor is not responsible for and will not replace any lost, mutilated or stolen prize or prize element or any prize that is undeliverable or does not reach a winner because of incorrect or changed contact information. If a winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and Sponsor will have no further obligation with respect to that prize or portion of the prize. No transfers, prize substitutions, or cash redemptions will be made, except at Sponsor’s sole discretion. Prizes may not be sold or otherwise offered for sale, barter, or auction. Sponsor reserves the right to substitute the stated prize or any component thereof with another prize or component of equal or greater value for any reason, including, without limitation, prize unavailability. No more than the stated prizes will be awarded. Entrants waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption and any liability and publicity which might arise from claiming or seeking to claim said prize.

LICENSE:

By entering, except where prohibited by law, each entrant grants to the Released Parties and their agents, successors and assigns in perpetuity the irrevocable, sublicensable, absolute right and permission to use, edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, separate, dub, adapt, publish, combine with other material, reuse, adapt, and exploit the content of and elements embodied in the Video Submission and Entry, and the Video Submission and Entry themselves, in any and all media (including but not limited to audiovisual, digital, and electronic media), whether now existing or hereafter devised, in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation. Each entrant agrees that the licensed entities may, but are not required to, attribute the Video Submission to entrant. Each entrant waives and releases the Released Parties from any and all claims that entrant may now or hereafter have in any jurisdiction based on “moral rights” or “droit moral” or unfair competition with respect to the Released Parties’ exploitation of Entries without further notification or compensation to participants of any kind, and agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Released Parties and each of their affiliates, licensees, or any other person in connection with this Contest, on the grounds that any use of any Video Submission or Entry, or any derivative works, infringe or violate any of participant’s rights (including MORAL RIGHTS) therein.

Each entrant acknowledges and agrees that nothing in these Official Rules will require a Released Party to use the Video Submission in part or in whole or to include the Video Submission in any Released Party-related property, including, without limitation, any Released Party’s web site or any other online or offline property. Each entrant hereby acknowledges and agrees that the relationship between the entrant and any of the Released Parties is not a confidential, fiduciary, or other special relationship, and that the entrant’s decision to submit his/her Video Submission for purposes of the Contest does not place any of the Released Parties in a position that is any different from the position held by members of the general public with regard to elements of the Video Submission, other than as set forth in these Official Rules. Each entrant understands and acknowledges that Sponsor has wide access to ideas and other artistic materials. Each entrant also acknowledges that many ideas or stories may be competitive with, similar to, or identical to his/her Video Submission and/or each other in idea, components, format, or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material that has or may come to Sponsor from other sources. Each entrant acknowledges and agrees that Sponsor does not now and will not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the entrant’s copyright in and to his/her Video Submission, if any. Each entrant acknowledges that, with respect to any claim by participant relating to or arising out of a Released Party’s actual or alleged exploitation or use of any Video Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition, or other exploitation of any Released Party property or production, and entrant’s rights and remedies in any such event are strictly limited to the right to recover damages, if any, in an action at law.

LIMITATION OF LIABILITY:

EACH ENTRANT AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY THE RELEASED PARTIES FROM ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE ACCEPTANCE, POSSESSION, USE, MISUSE OR AWARDING OF THE PRIZE OR ANY PRIZE ELEMENT OR WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE- OR CONTEST-RELATED ACTIVITY INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY. EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES OR PARTICIPATING ELIGIBLE COUNTRY ARE HEREBY EXPRESSLY WAIVED BY HIM/HER AGAINST THE RELEASED PARTIES. SECTION 1542 READS AS FOLLOWS:

“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

ADDITIONAL DISCLAIMERS: Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, the entrant or by human error: Entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or Entries in excess of the stated limit; any lost, late, incomplete, illegible, mutilated, or misdirected Entries, e-mail, mail, or Contest-related correspondence or materials or postage-due mail; any error, omission, interruption, defect, or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos or misprints in these Official Rules, in any Contest-related advertisements, or other materials; failures of electronic equipment, computer hardware or software; lost or unavailable network connections, or failed, incorrect, incomplete, incomprehensible, inaccurate, garbled or delayed electronic communications or entry information. Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s e-mail account to receive e-mail messages. Released Parties are not responsible, and may disqualify an entrant, if his or her e-mail address, telephone, or other contact information does not work or is changed without entrant giving prior written notice to Sponsor. Without limiting any other provision in these Official Rules, Released Parties are not responsible or liable to any entrant or winner or any person claiming through such entrant or winner for failure to supply the prize or any part thereof in the event that any of the Contest activities or the Released Parties’ operations or activities are affected, as determined by the Sponsor in its sole discretion, including, without limitation, by reason of any acts of God, any law, rule, regulation, action, order, or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), blackout, earthquake, fire, flood, epidemic, explosion, unusually severe weather, or hurricane; embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause, whether or not specifically mentioned above.

GENERAL RULES: By entering the Contest (except where prohibited by law), each entrant grants the Released Parties the irrevocable, sublicensable, absolute right and permission to use, publish, post or display his or her name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to him or her and any other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Released Parties’ sole discretion) for advertising, trade, promotional and publicity purposes, without further obligation or compensation of any kind to him or her, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), worldwide, without any limitation of time and without notice, review, or approval and each entrant releases all Released Parties from any and all liability related thereto. Nothing contained in these Official Rules obligates Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use.

Sponsor’s decisions will be final in all matters relating to this Contest, including interpretation of these Official Rules, accounting of valid Shares, selection of the winner, and awarding of the prize. All participants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Failure to comply with these Official Rules may result in disqualification from this Contest. Participants further agree to not damage or cause interruption of the Contest and/or prevent others from participating in or engaging with the Contest. Sponsor reserves the right to restrict or void Entries, Shares, or other participation from any IP address if any suspicious entry, Share, and/or participation is detected. Sponsor reserves the right, in its sole discretion, to void Entries of any entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Contest, including, without limitation, interfering (directly or indirectly), with the integrity of the Share mechanism. Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency within these Official Rules), it will be resolved in Sponsor’s sole discretion. Entrants waive any right to claim ambiguity in the Contest or these Official Rules. If Sponsor determines at any time in its sole discretion that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. If the Contest is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest and award the prize from eligible Entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains Entries or Shares by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law. In the event of a dispute concerning the identity of a participant who enters using the Contest Site, the participant will be declared to be the registered account holder of the e-mail address submitted with the Entry, but only if that person meets all other eligibility criteria, otherwise the Entry may, in Sponsor’s sole discretion, be disqualified and any potential prize won will be forfeited. A registered account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be required to provide Sponsor with proof that he/she is the registered account holder of the e-mail address associated with the potentially winning entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the Entry will be deemed ineligible. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST VIOLATES CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

DISPUTES/GOVERNING LAW:

Except where prohibited, as a condition of participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the entrant and any Released Party, claims and causes of action arising out of or connected with this Contest, or the prize awarded, or the determination of the winners must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (if any), not to exceed ten U.S. dollars ($10 USD), and entrant further waives all rights to have damages multiplied or increased.

This Contest and any dispute arising under or related thereto (whether for breach of contract, tortious conduct or otherwise) will be governed by the laws of the State of Illinois, without reference to its conflicts of law principles. Any legal actions, suits or proceedings related to this Contest (whether for breach of contract, tortious conduct or otherwise) will be brought exclusively in the state or federal courts located in or having jurisdiction over DuPage County, Illinois and each entrant accepts and submits to the personal jurisdiction of these Illinois courts with respect to any legal actions, suits, or proceedings arising out of or related to this Contest.

Yes, exactly! This is your chance to show the world your dance moves and rock your ELFIE socks off!!!

How many people can I have in my video?

You can have up to 5 people participate in your Office Party video.

How will OfficeMax choose the winning Video?

The Top 10 videos submitted by a Business and a Group will go into a review process. The videos will be judged on the basis of creativity, entertainment and staying true to the spirit of the original animated OfficeMax® Elf Office Party Dance.

The more people you share with on Facebook, Twitter, email, and text messaging, the greater your chances are of winning the Prizes.

How will I know if I am winning?

Visit sSnapp.com/OfficePartyContest and log into your account. You can sort the videos by “Most Votes,” the Top 10 videos with the most votes will enter the review process to win the Prizes.

When does the contest end?

December 24, 2013 at 11:59pm CST we will stop accepting video submissions.

When will OfficeMax announce the winners?

Winners will be announced on New Year’s Eve, December 31, 2013! Winners will be contacted by email and phone.

If I win, how do I receive and redeem my prize?

OfficeMax will contact the winners by email address and phone with instructions to redeem your prizes.

How many videos can I upload?

Only one video submission per person.

What’s the difference between Business and Group video submissions?

To submit a Business video everyone in the video must work at same company. Prizes will be awarded to the entire office, not the individuals.
Group Videos can be submitted by any group of friends. Prizes listed will be awarded to the group as a whole.

Why is the video I uploaded not showing up?

There is an approval process before the video will be displayed in the video player. Please allow 24 hours to be approved and uploaded to the contest website.

How can I remove my video from the contest?

Please send an email to info@ssnapp.com, include your name, video title, and reason for deletion.

My video won’t upload or some other technical question.
